A: Sustainability Declaration is a form which needs to be completed by seller from 1st January 12, 2010 in Queensland to inform buyers about the sustainability features of a property in order to increase community awareness of the value of such features. A sustainability declaration is a compulsory checklist that must be completed by the seller when selling a house, townhouse (class 1a buildings) or unit (class 2 building) from 1 January 2010 in Queensland.

A: As per the new legislation, from 1st January, 2010 real estate agents, as well as private sellers are not allowed to advertise their property for sale, unless the advertisement states where the copy of the sustainability declaration can be obtained.
This is not required for advertisements in newspapers and magazines or signs that are not designed to specifically advertise the sale of a property as for example ‘for sale’ sign.
A: Everyone is concerned about the impact of climate change and this is a step to improve existing dwellings. Buyers are encouraged to buy residential homes that are more sustainable. Properties that have more sustainable features will be key points for sales for real estate agents and sellers as they have lower energy costs and use less water, in the end saving more cost to the occupant in the long run.
The goal of Sustainability declaration is to increase awareness able sustainable dwellings when a property is listed for sale. It will help to promote financial and environmental benefits that could be achieved with specific features.
A: Sustainability declaration form has to be completed by the property owner as it is self assessable. However if the owner is not able to complete the form they can seek help from professional persons to complete it on their behalf, as long as the owner signs the form. In some cases where the owner cannot sign the form, a person authorized under a power of attorney or other statutory power may sign the form
A: If incorrect information is given on sustainability declaration and if the buyer realizes that the seller has prepared the form without reasonable skill and care the seller may be liable to compensate the buyer for the loss or expense. E.g. where a seller claims solar hot water is installed and it is not.
